Bungie Responds To Copyright Infringement Lawsuit Regarding 'Destiny 2 Red War' Campaign
Copyright lawsuits can often be complicated things. It’s often difficult to conclusively prove that one creator stole from another, especially when some of the ideas, visuals, characters, etc, are vague enough that one company can claim that any resemblance is accidental. Such is the case with the lawsuit against Bungie, the developers behind Destiny 2, and writer Matthew Kelsey Martineau, who is asserting that Bungie stole several aspects from some of his unpublished works. Bungie has officially responded, saying:
“Plaintiff’s Complaint fails to set forth any viable claims against Bungie because Plaintiff failed to plausibly allege that Bungie copied constituent elements of Plaintiff’s work that are original, and, specifically, that the Complaint fails to plausibly allege factual copying by Bungie and that the works incorporated by reference into the Complaint are not substantially similar as a matter of law.”
They continued with a few more shots of their own, saying:
“Bungie respectfully prays that this Court dismiss Plaintiff’s Complaint and all counts against Bungie, with prejudice, and further requests an award of the fees and costs Bungie incurred in defending this claim.”
If Martineau does have a case, it will probably be a major uphill battle. If he loses, he could be on the hook for a lot of money to Bungie.
